These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and AI Ad Genius ("we," "us," or "our"). By creating an account or using our platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our services.

Please read these Terms carefully before using AI Ad Genius.

2. Description of Service

AI Ad Genius is an AI-powered advertising platform designed specifically for automotive dealerships in the United States. Our platform enables you to:

  • Scrape your dealership website to extract brand information and vehicle inventory data.
  • Generate advertising copy, images, and videos using artificial intelligence.
  • Publish and manage advertising campaigns on Google Ads, Meta (Facebook and Instagram), and TikTok.
  • Automate campaign optimization through AI-driven analysis and market research.

3. Account Registration

To use AI Ad Genius, you must create an account by providing accurate, complete, and current information. You are responsible for:

  • Maintaining the confidentiality of your login credentials.
  • All activity that occurs under your account.
  • Notifying us immediately of any unauthorized access to or use of your account.

We reserve the right to suspend or terminate accounts that contain inaccurate information or that we reasonably believe are being used in violation of these Terms.

4. Website Scraping Consent

By submitting a URL to our platform, you represent and warrant that you have the authority to access and scrape the publicly available content of that website. You agree not to submit URLs of websites you do not own or have authorization to analyze.

You acknowledge that our automated tools will access the provided URL to extract publicly available information, including but not limited to business details, branding elements, and vehicle inventory data. You accept full responsibility for ensuring that your use of this feature complies with all applicable laws and the terms of service of the target website.

5. Subscription and Billing

AI Ad Genius offers subscription-based access to its features. Subscription plans and pricing are displayed on our platform and may be updated from time to time.

  • Payment Processing: All payments are processed securely through Stripe. By subscribing, you authorize us to charge your selected payment method on a recurring basis.
  • Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date.
  • Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of that period.
  • Refunds: We do not provide refunds for partial billing periods. If you cancel mid-cycle, you will continue to have access through the remainder of the paid period but will not receive a prorated refund.

6. AI-Generated Content

Our platform uses artificial intelligence to generate advertising content, including text copy, images, and videos. You acknowledge and agree that:

  • AI-generated content may not always be accurate, complete, or suitable for your specific needs. You are responsible for reviewing and approving all content before publication.
  • We do not guarantee any specific advertising performance, return on investment, or results from AI-generated content.
  • Ownership of Generated Content: You own the ad content generated through your use of the platform, subject to any rights retained by the underlying AI providers.
  • Service Improvement: We retain the right to use anonymized and aggregated data derived from platform usage to improve our services, train models, and enhance the overall user experience.

7. Acceptable Use

You agree not to use AI Ad Genius to:

  • Generate, publish, or distribute content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
  • Submit URLs of websites you do not own or are not authorized to scrape or analyze.
  • Attempt to abuse, overload, or interfere with our APIs, servers, or infrastructure.
  • Circumvent any access controls, rate limits, or security measures.
  • Use the platform for any purpose other than legitimate automotive advertising.
  • Resell, sublicense, or redistribute access to the platform without our written consent.

We reserve the right to suspend or terminate your account if we determine, in our sole discretion, that you have violated these acceptable use terms.

8. Third-Party Platforms

AI Ad Genius facilitates the creation and publication of advertisements on third-party platforms including Google Ads, Meta (Facebook and Instagram), and TikTok. You acknowledge and agree that:

  • We do not control the policies, terms of service, or content guidelines of these third-party platforms.
  • You are solely responsible for complying with each platform's advertising policies and terms of service.
  • We are not liable for any ad rejections, account suspensions, or policy violations imposed by third-party platforms.
  • Connecting your third-party advertising accounts to AI Ad Genius is done at your own risk and discretion.

9. Intellectual Property

Platform Ownership: AI Ad Genius, including its design, code, features, algorithms, templates, and documentation, is the intellectual property of AI Ad Genius and is protected by applicable intellectual property laws.

User-Generated Content: You retain ownership of the advertising content generated through your use of the platform.

Templates and Ad Packs: Pre-built templates, ad packs, and other creative assets provided through the platform are licensed to you for use within AI Ad Genius. They are not sold and may not be redistributed, resold, or used outside the platform without prior written consent.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AI AD GENIUS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM.

We do not guarantee any specific advertising performance, revenue generation, or return on investment. The effectiveness of AI-generated content depends on numerous factors beyond our control, including market conditions, competition, and platform algorithms.

We are not liable for ad rejections, account suspensions, or policy violations imposed by third-party advertising platforms.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless AI Ad Genius and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the platform.
  • Your violation of these Terms.
  • Your violation of any applicable law or regulation.
  • Any content you generate, publish, or distribute using the platform.
  • Your scraping of any website in violation of that website's terms of service.

12. Termination

Either party may terminate this agreement at any time. You may terminate by canceling your subscription and ceasing use of the platform. We may terminate or suspend your access if you violate these Terms or for any other reason at our sole discretion.

Upon termination, your data will be retained for thirty (30) days, during which time you may request an export of your data. After the 30-day retention period, your data will be permanently deleted from our systems, except where retention is required by law.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware.

14. Changes to Terms

We reserve the right to update or modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Effective Date" above. Your continued use of the platform after any changes constitutes your acceptance of the revised Terms.
